Embodied Divine Immersion – Continuing Membership / Renewal

Embodied Divine Immersion (“the Program”) is offered by:

By registering for or renewing participation in the Program, you agree to the following Terms & Conditions.

1. Eligibility

By registering, you confirm that you are at least 18 years of age and legally able to enter into this agreement.

2. Nature of the Program

The Program is provided for educational and spiritual development purposes. It is not therapy, medical treatment, psychological counseling, financial advice, or legal advice. Participation does not create a therapeutic, medical, or professional services relationship. No outcomes are promised or guaranteed. You remain responsible for your own wellbeing, including your physical, emotional, psychological, and spiritual health.

3. Program Delivery

Embodied Divine Immersion is an ongoing virtual program that includes live online sessions across recurring circles, session recordings, self-study materials, and other resources, as described in Program communications.

A renewal continues your participation in the ongoing Immersion rather than beginning a new program.

The Program is delivered virtually through third-party online platforms. Particular sessions, circles, schedules, formats, and resources may change over time as the Program evolves.

4. Technical Requirements & Access

Participation requires a stable internet connection, a compatible device, and the ability to access the designated platforms. Attendance, replay access, and delivery of materials are dependent upon third-party platform functionality, successful recording capture, and your ability to access the internet. Beneath the Sand, Inc. is not responsible for technical issues outside of its reasonable control, including but not limited to: internet connectivity issues, platform outages, email delivery delays, device incompatibility, and disruptions in recording capture. Replays and materials are hosted in password-protected online platforms and require internet access.

5. Library & Replay Access

During each additional year or month (depending on which subscription option you chose) of active Immersion participation, you have access to the complete archives of the Immersion circles and the included self-study libraries, and you may download the contents of your library – including the complete circle archives – exclusively for your personal, private use.

After each additional full year of Immersion participation concludes, the recordings of the live sessions from that year are added to your permanent online library.

6. Personal Use License

Your registration grants you a limited, non-transferable license to access and view Program recordings and materials for your personal, private use only during the access period. You may not reproduce, distribute, share, publicly display, upload, record, copy, modify, publish, transmit, or resell any portion of the Program, recordings, or materials. Program materials are not for use in your own client or teaching work.

7. Household Participation and Transfers

Registrations are non-transferable. A single household may participate together under one registration. Login credentials may not be reassigned, resold, or transferred to another individual or account.

8. Recording & Participation

Sessions will be recorded. If you turn on your camera, microphone, or participate verbally, your voice and image may be captured as part of the group recording. You may participate with camera and microphone turned off. Recordings may be used for replay access and future educational use.

9. No Refund Policy

All renewal payments are final and non-refundable.

Limited Exception – Accidental Duplicate Purchase: If you unintentionally purchase more than one registration for the same Program, you must notify support@kenwstone.com within 7 days of purchase. If verified as an unintended duplicate purchase, any duplicate registrations beyond one will be refunded. Refunds will be initiated within 10 business days of confirmation. Processing time thereafter depends on your financial institution. No other refunds will be provided.

10. Subscription, Renewal & Cancellation

The Immersion renewal is offered as an automatically renewing subscription, selected when you register – a monthly or annual renewal option, each of which renews automatically at the end of its applicable billing term.

Your selected payment method will be charged automatically on the applicable renewal schedule until you cancel.

Renewal cancellation requests may be made by email (support@kenwstone.com) and take effect at the end of the current billing period. Cancellation prevents the next scheduled renewal charge.

Your exchange remains grandfathered (the payment amount will never increase) for as long as your subscription remains continuously active. If you cancel and later rejoin the Immersion, the exchange will be whatever the current rate is at that time.

If a scheduled payment cannot be charged, you agree to provide an updated payment method promptly. Failure to make a required payment may result in suspension of access until payment is successfully restored.

11. Private Sessions

If your original Immersion registration included private sessions (and you renew with the same payment schedule – typically an annual renewal), you may request a grandfathered annual subscription for the same number of sessions at the same exchange. This subscription will be dependent on an ongoing active Immersion subscription. Sessions are for the registrant only, are non-refundable, are scheduled according to Ken’s availability, and are to be used while your Immersion subscription remains active.

12. Rescheduling

If Beneath the Sand, Inc. must reschedule any portion of a Program due to illness or circumstances beyond reasonable control, participants will be notified and provided with updated scheduling. If rescheduling is not reasonably possible, Beneath the Sand, Inc. may, at its discretion, provide credit or alternate access.

13. Assumption of Responsibility

By participating in the Program, you acknowledge that experiential work may bring forward a wide range of emotional, psychological, spiritual, or physical responses. You participate voluntarily and remain responsible for your own experience, including seeking appropriate support or care when needed.

14. Release, Waiver, and Hold Harmless

By participating in the Program, you agree to release, waive, and hold harmless: Beneath the Sand, Inc., Ken W. Stone, and their officers, employees, contractors, agents, representatives, affiliates, successors, and assigns from any claims, liabilities, demands, actions, damages, losses, costs, or expenses arising out of or related to: participation in the Program, use of any recordings or materials, reliance on any content provided, emotional, psychological, spiritual, or physical responses, decisions or actions taken following participation, and technical interruptions or third-party platform disruptions. This release includes claims based on ordinary mistakes or negligence, to the extent permitted by law. This release applies whether such claims are known or unknown at the time of participation.

15. Limitation of Liability

In the unlikely event liability is established despite the release above, Beneath the Sand, Inc. shall not be liable for indirect, incidental, special, consequential, or punitive damages. Any liability that is legally determined shall be limited to the amount paid for the Program registration.

16. Intellectual Property

All Program materials, recordings, and content remain the intellectual property of Ken W. Stone and Beneath the Sand, Inc. Unauthorized reproduction, distribution, or sharing is strictly prohibited.

17. Taxes

You are responsible for any taxes, VAT, duties, or governmental charges applicable in your jurisdiction.

18. Indemnification

You agree to indemnify and hold harmless Beneath the Sand, Inc. from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from: your violation of these Terms, your misuse of the Program or materials, your unlawful conduct, or your infringement of any intellectual property or third-party rights.

19. Class Action Waiver

You agree that any dispute or claim arising out of or relating to these Terms or the Program will be brought solely in your individual capacity. You waive any right to participate as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

20. Accessibility

Live sessions are conducted with live captioning and live translation enabled where available. Transcripts are included with replay access where available. If you have questions about accessibility, contact support@kenwstone.com.

21. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Colorado. Any dispute shall be resolved exclusively in the state or federal courts located in Colorado.

22. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms constitute the entire agreement between you and Beneath the Sand, Inc. regarding your registration and participation in the Program.
